ARTabstract
The question of the relationship between law and war is a long-standing one, and while European jurists may have paid it little attention for several decades, Russia's aggression against Ukraine in February 2022 has made it necessary to analyse the relationship between the two concepts. These relationships are complex. On the one hand, the law claims to govern war and impose limitations on it. On the other, war has an influence on the law, affecting its scope and conditions of application. The aim of this article is to provide a general overview of the issues raised by the return of war to legal thought, with a view to introducing a series of studies that will explore this question in greater depth in the various fields of international, European and domestic law, both private and public.
